What is a Trust?

  • A Trust is a legal entity created to hold and manager assets for the benefit of specified persons or entities. Think of this entity as a bucket that is created so that assets can be held and managed for the benefit of someone or something.  Many people work with an attorney or prepare a Trust on their own.  They have a nice, new "bucket" all ready to be filled up, but they never put anything into (or fund) their bucket.

 

  • There are many types of Trusts that serve many specific purposes. For instance, if your goal is to make sure your loved ones don't have to go through Probate Court in order to settle your affairs, a basic Revocable Living Trust may be all that is required. For others a more complicated Trust will be needed in order to protect the estate from unnecessary taxation. There is no "one-size-fits-all", which is why you should consult a competent Estate Planning Attorney to assess your particular needs.
